This includes contact information about you, such as your company name, title, phone number, address, your name, fax number, and email address. We may also include information on the services, products, or content which have interested you or which you may be interested in purchasing from us, as well as information on other individuals or companies that you do business with. We may also obtain Personal Information about you from third parties in connection with business transactions you have initiated with us, such as processes related to the transaction or through credit verification. Finally, if you share or interact with content from our Sites through or with a third party service, that third party service may collect information about you, such as your public profile, and may share that information with us. Any Personal Information received from third parties will be treated in accordance with this Privacy Policy.
3. ANALYTIC
TECHNOLOGIES
We use common methods and technologies to collect and store Usage Information about you and your interaction with our Sites, including but not limited to cookies, web beacons, and other analytic technologies.
A. Cookies. A cookie is a small text file placed on your device by websites that you visit. Cookies are widely used to make websites work, or work more efficiently, as well as to provide information to the owners of the website. We use cookies to remember your preferences and to conduct range measurement. If you block cookies, you may not be able to use all the features on our Sites.Please see our Cookie Policy for more information. Residents of the EU or other jurisdictions that require us to obtain their consent to use cookies on our Sites will be asked to manage their cookie preferences on such Sites. However, some cookies are essential to enable core site functionality and must not be disabled if you wish to use such Sites.
B. Embedded Scripts. An embedded script is a programming code designed to collect information about your interactions with our Sites, such as which links you click, what browser or device you use (e.g. desktop or mobile version) to visit our Sites. We use this information to improve the end user experience. This code is downloaded onto Your Device when you access our Sites and is deleted or deactivated when you leave our Sites.
C. Analytics. We use analytics applications, including Google Analytics, to collect information about use of our Sites. This information includes, but is not limited to, IP addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information to analyze trends, administer the Sites, track user movements around the Sites, and gather demographic information about our user base as a whole. These applications track users' web browsing habits in order to create a profile of their interests. We use information from these applications only to improve our Sites, services, and product offerings. The information generated from your use of our Sites will be transferred and saved to a server owned by the vendor, located in the United States. Google Analytics will mask the IP address of Member States of the European Union (EU) or other signatories of the Agreement on the European Economic Area. In rare cases, the full IP address will be shortened after it is transferred to a Google server in the United States. Google is able to use and share information about your visits to the Sites, but only in accordance with the Google Analytics Terms of Use and the Google Privacy Policy. 4. CUSTOMER END USER DATA This privacy policy does not apply to the data of our customers' end users. We are a data processor that processes the personal data collected by our customers in accordance with our customers’ instructions.Our customers may use the Sites and Services to better understand how their own users (“their own users”) engage with their products and services. The data we process about our customers' end users is called "Customer End User Data." The type of Customer End User Data our customers process is chosen by them, not by us.
We process Customer End User Data in accordance with the instructions of customers.
If you are a customer's end user, your data is governed by the customer's privacy policy. You should review the customer's privacy policy to learn more about their data handling practices.
We do not have a relationship with Customer End Users, but rather only with our customers. An individual may have the right to access, delete and amend the data collected about that individual.
If you are a customer and you would like to access, amend or delete your data, then you need to contact our customer service department. We will respond to any such request from our customer within a reasonable period of time.
5. HOW
WE USE YOUR INFORMATION
Business Use. We use your Personal Information mainly to provide you with products or services you have requested from us (“Transaction Use”) as follows:
(1) We will respond to any inquiries or questions you may have about our services or products. We may also use your Personal Information as required to comply with laws and regulations in any of the jurisdictions in which we or our affiliated companies operate, including the United States.
(2) We may use Usage Information internally to help us improve our services or products, or to develop new services or products. This information may include, but is not limited to, how you use our products and services, your interactions with other users, and your contact information.
(3) to keep you updated on changes to the way these procedures and policies may be used
(4) to ensure that the contact information and account we have on file for you and your company are accurate with regards to our services or products.
(5) to provide you with support and training on how to use these services or products.
(6) to create an account with us so that you may access our Sites or other services

(8) to process your business transactions with us, including without limitation orders of services and products and the creation of user profiles.

We may also use your Personal Information to personalize the content of the Sites and communications based on your preferences, to comply with our contractual or legal obligations and to resolve disputes.

Marketing Purposes. Subject to your consent or as otherwise permitted by law your personal information may be used to market our products, services, and content, or those of our business partners, as follows:

(6) to promote or market our services or products to you, including by providing you with information about our services or products
Referrals. We often receive Personal Information about you from other people who suggest that we contact you for business purposes.
(1) We only collect Personal Information from you if you have given your consent for the third party to share your Personal Information.
(2) We will only contact you if you are interested in our services or products, or those of our business partners.
(3) We will not use this information for other purposes without your permission.
(4) We will stop using the information you provide to us to contact you if you request us to do so.
Data Integrity. You are responsible for the accuracy of all Personal Information that we receive from you.
(1) We will use reasonable efforts to ensure and maintain the accuracy and integrity of your Personal Information, and to update that information as often as is appropriate.
(2) We will take all reasonable steps to ensure that when we collect Personal Information from you it is relevant to its intended use, and that it is used only in ways that are authorized by you.
6. RETENTION OF PERSONAL INFORMATION
We keep Personal Information we collect from you where we have a legitimate business need that requires us to do so. This need could be to provide you with a service you have requested or to comply with applicable accounting, tax or legal requirements.
7. WITH WHOM WE MAY SHARE INFORMATION
Within OnTask.AI. OnTask.AI conducts business with customers and suppliers in other countries. We may share your Personal Information within OnTask.AI (i.e., among and between OnTask.AI and its subsidiaries) from time-to-time and subject to the provisions of this Privacy Policy governing “CHOICE AND UPDATING YOUR INFORMATION AND PREFERENCES” (see below). We may use such information for our operational and internal business purposes, as well as for purposes consistent with the purpose for which the information was originally collected or subsequently authorized by you.
Outside of OnTask.AI. Your Personal Information may have been shared with other third parties, as described below, or as subsequently authorized by you. Occasionally, we may offer you the option of sharing your Personal Information with third parties in order to receive marketing offers and/or information from them. If you allow the sharing of your Personal Information for these purposes, it may be subject to the business practices and privacy policies of such third parties. If you decide that you no longer want us to share your Personal Information with such third parties, please contact us using the instructions indicated below under the section “UPDATING YOUR INFORMATION AND PREFERENCES.” We will process your request as soon as possible. If you no longer want to receive communications from a company that has your personal information, you will need to tell that company directly.
Data Processors.We may occasionally employ Data Processors to help us with specific tasks, such as:
(1) communicating with you about our services and products.
(2) performing other services for us that are not related to our core business.
We may give these Data Processors access to your Personal Information in order for them to perform services or otherwise complete a requested transaction for us.
(3) hosting our Sites, products, and other applications on behalf of our customers.
(4) supporting marketing events and activities related to our services and products, or those of our business partners.
(5) fulfilling and processing orders for our products and services

Managed Service Providers. We may share your contact information with third parties who provide a service or offer that is integrated with the OnTask.AI product. If you are a customer of a managed service provider that is also a distributor or reseller of OnTask.AI, you may purchase the OnTask.AI product directly from them.
Implementation Partners. We may share your contact information with partners who can help you with integration and implementation of OnTask.AI into your environment.
Training Delivery Partners. We may share your contact information with partners that we work with to offer you training for OnTask.AI products. These partners may use your contact information to facilitate the delivery of the training directly to you.
Site Hosting. Our Sites and hosting servers are operated in countries where we conduct our business. We may transfer and/or process Personal Information associated with our Sites in a country other than the one from which it was collected. The data protection laws in those countries can differ from those of your country in some cases. Third party service providers may operate servers. If you are a resident of the EU, we will only make such transfers in accordance with applicable laws.
Links to Other Websites. Websites and applications that are not affiliated with us may have links on our website. We are not responsible for the privacy practices or the content of these websites or applications. We encourage our users to read the privacy policies of these websites and applications before providing them with any information. Some websites contain links to social media and other third-party applications or websites that provide additional services, goods, information, and/or promotions. OnTask.AI does not own or operate any third-party applications or websites. These applications or websites may have their own separate data collection and privacy practices. We are not responsible for the privacy policies or practices of any third party
Affiliates and Business Transfers. We may share your Personal Information with our parent company and its affiliates. OnTask.AI may be sold at some point in the future, including our Sites. Your Personal Information may be transferred to a subsequent owner, co-owner, or operator of the business unit or Sites. Likewise we may disclose and transfer your Personal Information in connection with a corporate merger, restructuring, consolidation, the sale of stock or assets, or other corporate change, including, without limitation, during the course of any due diligence process. In all such cases, this Privacy Policy governs the use and disclosure of such information.
Legal Protections and Law Enforcement. We may use, access, preserve, disclose, and transfer your Personal Information to third parties for the following reasons:
(1) to prevent, detect, or otherwise address any fraudulent activity, security breaches or issues, or technical issues. 8. CHOICE AND UPDATING OF YOUR
INFORMATION AND PREFERENCES
We reserve the right to ensure that the person seeking access to Personal Information is who they say they are. We may provide web pages or other mechanisms on our Sites whereby you can update your subscription preferences/settings. You can also contact us to update your Personal Information or change your preferences by visiting our website and clicking on the "My Account" link. If you receive a marketing communication from us by email, you may also opt out of receiving future email marketing communications by clicking on the unsubscribe link included in that email.
Certain communications relating to your customer account, use of our Sites, or other business matters may be unaffected if you choose to opt-out from marketing communications. We may delete certain records that contain your Personal Information in accordance with applicable law and routine recordkeeping.
We reserve the right to delete or destroy any information we deem unnecessary or no longer needed. We disclaim any liability related to, or arising out of, the destruction of that information.
We understand that you may want all your information removed from our databases, however it is not always possible. This is because of things like backups, and other similar reasons. Residual data may remain.

We will take all reasonable precautions to protect your Personal Information in our possession from misuse, loss, and unauthorized access, disclosure, destruction or alteration. We will make reasonable efforts to keep your Personal Information complete, current, accurate, and reliable for its intended use. We will take additional precautions as needed to ensure the security of especially sensitive information, such as credit card information. Although we make every effort to protect your Personal Information, we cannot guarantee or warrant that this information will be protected under all circumstances, including those beyond our control.

11. CHILDREN
The Sites are not intended for personal use.
We do not knowingly request or collect Personal Information from any individuals under the age of 18. If you are under 18, please do not provide any Personal Information about yourself on the Sites. We will delete Personal Information from a child under age 18 as quickly as possible if we learn that we have collected it. If you believe that a child under the age of 18 may have provided us Personal Information, please contact us at privacy@OnTask.AI.
12. EUROPEAN
DATA SUBJECTS
The terms "Personal Data" and "processing" as defined in the GDPR shall be used in this document. OnTask.AI processes your Personal Data on the Sites. We may also process Personal Data of our customers' employees or end users in connection with our provision of services to customers, in which case we are the controller of Personal Data. If you are a data subject and would like to exercise your rights with respect to your Personal Data, please contact the controller party first. If this section conflicts with any other section or provision of this Privacy Policy, the section or provision that is more protective of Personal Data shall be controlling.

13. TRANSFERS OF PERSONAL DATA
If we make any transfer of Personal Data from the EU to a third country or territory outside the EU, we will ensure that the transfer is subject to appropriate safeguards in accordance with the data protection laws. OnTask.AI understands the potential for liability in cases of onward transfer to third parties, and will take steps to protect your information.
OnTask.AI does not transfer Personal Data to unrelated third parties, except when lawfully instructed to do so by a client, or in certain limited or exceptional circumstances as required by law.
14. LAWFUL BASES FOR PROCESSING
We will only process your Personal Data if it is necessary for the performance of a contract to which you are a party, or to take steps at your request prior to entering into a contract. The lawful basis for processing may include our legitimate interests, contractual necessity, consent, or other processing grounds, each of which are described in greater detail below.
Contractual Necessity: We process your Personal Data as a matter of “contractual necessity,” meaning that we need to process the data in order to perform our agreement with you. We need this information to provide you with the services and products you request.

Other Processing Grounds. We may process Personal Data to comply with a legal obligation if need be to protect the vital interests of you or other individuals, or for tasks performed in the interest of the public. What are your rights with respect to your personal data?
Rights regarding your Personal Data. If you would like to learn more about our company's privacy practices, or if you have any questions or requests, please contact us by email at privacy@OnTask.AI. We may not be able to fully comply with your request if it is impractical or frivolous, if it is not required by law, or if it jeopardizes the rights of others. Even if that is the case, we will still notify you of our decision. We may need you to provide us with additional information, including Personal Data, to verify the nature of your request and your identity.
Access. You may request a copy of the Personal Data we hold about you, as well as more information about such Personal Data. You can also access certain aspects of your Personal Data by contacting us at privacy@OnTask.AI to change or update your information.
Rectification. If you believe that any Personal Data we are holding is incomplete or incorrect, you can ask us to update or correct such data. If you have questions or concerns about how your personal information is collected or used, please contact us at privacy@OnTask.AI. We will be happy to answer any questions you may have.
Erasure. You may request that we erase all or some of your Personal Data from our systems. We will endeavor to fulfill your request, but we may not be able to do so in all cases.
Withdrawal of Consent. If you have given your consent for your Personal Data to be processed, you have the right to change your mind and withdraw your consent at any time.
However, please note that if you exercise this right, you may then have to provide express consent on a case-by-case basis for the use or disclosure of certain aspects of your Personal Data, if such use or disclosure is necessary to enable you to use some or all of our Sites.
Portability. You can request a copy of your Personal Data in a machine-readable format.
You may also request that we send the data to another controller.

15. ARBITRATION
If you are an EU subject with an unresolved dispute or complaint arising under the requirements of the Privacy Shield, we shall refer your complaint to an independent dispute resolution mechanism, specifically the International Centre for Dispute Resolution, the international division of the U.S.-based American Arbitration Association. We will also cooperate with the European Data Protection Board's (EDPB) complaint handling mechanism. We are also subject to the investigatory and enforcement powers of the Federal Trade Commission with respect to our compliance with the Privacy Shield. 16. PRIVACY SHIELD
Workforce Technologies INC. D.B.A. OnTask.AI complies with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the use, collection, and retention of personal information transferred from the European Union to the United States.
Workforce Technologies INC.D.B.A.OnTask.AI certifies to the Department of Commerce that it will protect the privacy of individuals in accordance with the Privacy Shield Principles.
If there are any conflicts between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. However, if the conflict results in the inability to comply with the Privacy Shield Principles, we will inform you and take reasonable steps to remedy the conflict.

17. CALIFORNIA RESIDENTS
RIGHTS
The California Consumer Privacy Act (CCPA) was enacted in 2018 and will take effect on January 1, 2020. The CCPA imposes certain obligations on us and grants certain rights to California residents (“you” or “your”) with regard to their “personal information” (as defined under the CCPA). If you are a California resident, please review the information below about your potential rights with regard to your personal information under the California Consumer Privacy Act (CCPA). The rights described herein may be subject to exemptions and other limitations under applicable law. OnTask.AI is a “business.” For the purposes of this policy, Personal Information means any information that identifies, describes, relates to, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a California resident or a household. This does not include information that has been aggregated from multiple consumers, information that has been de-identified, or information that is publicly available.
We collect and use your personal information to provide you with products and services, to improve our products and services, to communicate with you, and to manage and improve our operations. We may have collected from or about you any or all of the categories of Personal Information listed in “INFORMATION WE COLLECT ABOUT YOU” in the prior 12 months. We may collect Personal Information from any or all of the following categories of sources:

Right Not to Be Discriminated Against. Exercising any of your rights under the CCPA shall not cause any discrimination against you.
Right to Request Opt-Out of Sale. OnTask.AI does not sell your Personal Information under CCPA. We would appreciate it if you did not sell our Personal Information.
The CCPA does not restrict OnTask.AI's ability to do things such as complying with other laws or regulatory investigations. OnTask.AI reserves the right to delete, and not to retain, certain Personal Information after receiving a request to delete when permitted to do so by the CCPA.
To Submit A Request to know or to delete under the CCPA, you can either fill out our online form or send us a letter.
If you are a California resident and your Personal Information is subject to the CCPA, you can submit a Request to Know and/or a Request to Delete by calling the following telephone number 1-800-460-4631, or by sending an email to privacy@OnTask.AI.
OnTask.AI is obligated to provide certain information or delete Personal information in response to a verifiable request made by a California Resident or their legally authorized agent.
We may need to request specific information from you or your authorized agent to help us confirm your identity or your agent’s authorization to act on your behalf and ensure your right to access the information being requested. The information gathered during the verification process will only be used for the purpose of verification.
An authorized agent seeking to submit a Request to Know or a Request to Delete on a California Resident’s behalf, may do so by any of the methods mentioned above, however the agent must provide:
● their own name and contact information
● the name and contact information of the person on whose behalf they are acting
The signer must have a signed authorization from the California Resident authorizing them to act on such California Resident’s behalf, unless they can prove that the California Resident has granted them power of attorney pursuant to California Probate Code sections 4000 to 4465.
The company must provide evidence of their registration with the California Secretary of State in order to conduct business in California. We also require that the California Resident verify their own identity with us and provide us with written permission from the authorized agent to submit the request on their behalf. We will provide a response to any consumer request free of charge, online, by mail, or electronically, as you choose.
18. NEVADA RESIDENT RIGHTS
Residents of Nevada have the right to refuse the sale of their personal information, as long as they meet the requirements. The terms used in this section shall have the meaning ascribed to them in the Nevada Privacy Law, unless otherwise specified. This section applies to Nevada residents only.
Personal Information. An operator collects any one or more of the following items of personal information about a consumer through an Internet online service or website: (i) first and last name; (ii) the address of a person's home or other physical location, which includes the name of a street and the name of a city or town. (iii) email address; (iv) telephone number;
(v) social security number; (vi) a way to contact someone either online or in person (vii) information about a person collected from the person through the Internet website or online service of OnTask.AI and maintained by OnTask.AI in combination with an identifier that makes the information personally identifiable.
Sale. The exchange of covered information for monetary consideration by the operator to a person is known as a sale. A person may license or sell the covered information to additional persons.
OnTask.AI does not sell the Personal Information of Nevada Residents.
19. CHANGES
TO THE PRIVACY POLICY
We reserve the right to change this Privacy Policy at any time, without prior notice to you, to the extent permitted by applicable law. We will post any changes to this Privacy Policy on the Sites, and those changes will be effective immediately.
